If specific terms and conditions apply in addition to these general terms and conditions, these will be communicated to the customer in advance.
In the event of a conflict between these general terms and conditions and specifically agreed terms (agreed in writing), the specific terms shall prevail to the extent permitted by law.
Article 4 – The offer
Kingdom Crown Collection describes products as completely and accurately as possible.
Images, colors, and dimensions are displayed as faithfully as possible. Minor deviations may occur due to screen settings, materials, manual production, or the natural properties of materials.
Obvious mistakes or errors in the offer do not bind Kingdom Crown Collection.
For every offer, the following is clearly stated, where applicable:
the price;
any additional costs;
the method of payment; the method and timeframe of delivery;
any limitations on the right of withdrawal;
any specific conditions regarding custom-made or personalized items.
Article 5 – Formation of the agreement
An agreement is concluded once the customer has accepted the offer and any associated conditions have been met.
For electronic orders, the customer receives an electronic order confirmation.
Kingdom Crown Collection reserves the right to refuse an order if there are reasonable grounds for doing so—for example, if a product is unavailable or if the information provided is manifestly incorrect.
For business orders involving custom work, the agreement may be concluded through written acceptance of a quotation.
Article 6 – Prices
Prices for consumers are displayed inclusive of VAT, unless stated otherwise.
Prices for business customers may be quoted exclusive of VAT.
Any shipping, insurance, import, or other additional costs will be clearly stated prior to the conclusion of the agreement.
A separate quotation may be issued for personalized products.
Article 7 – Payment
Consumers make payments using the methods offered during the ordering process.
For business customers, the payment terms specified in the quotation, order confirmation, or agreement apply.
Kingdom Crown Collection may require a down payment for custom-made business orders. The amount of such a payment is agreed upon in writing in advance.
In the event of late payment by a business customer, Kingdom Crown Collection is entitled to suspend the fulfillment of further orders, to the extent permitted by law.
Consumers retain all statutory rights arising from applicable consumer protection laws.
Article 8 – Delivery
1. Kingdom Crown Collection delivers to the address specified by the customer.
2. The expected delivery timeframe is stated before or during the ordering process.
3. Custom-made and personalized products may be subject to a longer production time. The customer will be informed of this in advance.
4. If an order cannot be delivered or cannot be delivered on time, the customer will be informed as soon as possible.
5. In the case of sales to a consumer, the risk associated with a product passes at the moment the consumer—or a third party designated by them—has received the product, unless the law provides otherwise.
6. In the case of business-to-business sales, the risk passes in accordance with the agreements made or, in the absence thereof, in accordance with applicable law.
Article 9 – Right of withdrawal for consumers
1. When purchasing a standard product online, a consumer generally has the right to withdraw from the agreement within the statutory cooling-off period of 14 days without giving a reason.
2. The cooling-off period generally commences on the day after the consumer receives the product.
3. The consumer must notify Kingdom Crown Collection within the cooling-off period that they are exercising their right of withdrawal.
4. Following withdrawal, the consumer must return the product within the statutory time limit.
5. The product must be handled with care as far as reasonably possible and used only to the extent necessary to assess its nature, characteristics, and functioning.
6. If the product has been used beyond what is necessary for such an assessment, the consumer may be held liable for any depreciation in value, to the extent permitted by law. 7. The direct costs of returning the goods shall be borne by the consumer, unless agreed otherwise or if Kingdom Crown Collection is legally required to bear these costs.
8. In the event of a valid withdrawal, Kingdom Crown Collection shall refund the payments received in accordance with the statutory timeframes and conditions.
Article 10 – Exclusion of the right of withdrawal for personalized products
1. The statutory right of withdrawal does not apply to products subject to the statutory exception regarding the right of withdrawal.
2. This may apply, inter alia, to products that:
o have been manufactured according to the customer's specific wishes or specifications; or
o are clearly personal in nature.
3. Examples may include:
o personal engravings;
o names;
o dates;
o personal texts;
o specific designs;
o custom sizing;
o personalized memorial jewelry.
4. A standard product where the customer merely selects from pre-offered options is not automatically considered a personalized product. Kingdom Crown Collection shall state, prior to the conclusion of the agreement, when the right of withdrawal is excluded for a specific product.
Article 11 – Memorial jewelry and handmade jewelry
1. Kingdom Crown Collection may offer—including under the brand or concept *Urna de Rosa Eterna*—both standard-produced memorial jewelry and personalized, handmade gold and silver memorial jewelry.
2. Standard-produced products are subject to the normal statutory rules applicable to consumers.
3. The statutory exception to the right of withdrawal may apply to personalized jewelry or jewelry manufactured specifically according to the customer's wishes. 4. Before commencing work on a personalized design or custom-made item, the customer will receive—where relevant—a description of the chosen personalization and the agreed price.
5. Minor variations may occur in handmade jewelry and do not automatically constitute a defect.
Article 12 – Conformity and statutory warranty
1. Kingdom Crown Collection guarantees that consumer products comply with the agreement and the applicable statutory requirements.
2. If a product fails to comply with the agreement under normal use, the consumer is entitled to the statutory rights arising from non-conformity.
3. Any commercial warranty provided is in addition to, and does not limit, the consumer's statutory rights.
4. For business customers, warranty and conformity arrangements are—where applicable—set out in the quotation, agreement, or business terms and conditions.
Article 13 – Business customers and resellers
1. Business customers and resellers do not act as consumers.
2. Consumer law does not apply to B2B agreements, unless mandatory law provides otherwise.
3. A business customer has no statutory right of withdrawal applicable to consumers.
4. Separate agreements may be made with resellers regarding:
o purchase prices;
o minimum order quantities;
o payment;
o delivery;
o product presentation;
o use of images and branding materials;
o warranty;
o returns;
o resale.
5. If Kingdom Crown Collection enters into a separate business agreement with a reseller, that agreement shall prevail over these general terms and conditions to the extent that it expressly deviates from them.
Article 14 – Retention of title
1. To the extent permitted by law, a product delivered to a business customer remains the property of Kingdom Crown Collection until all amounts due have been paid in full.
2. The business customer shall not alienate or encumber the products subject to the retention of title, except in the ordinary course of business and to the extent permitted by law.
Article 15 – Complaints
1. Complaints may be submitted via info@kingdomcrowncollection.nl.
2. A complaint should be described as clearly as possible and, if possible, be accompanied by photographs and the order number.
3. Kingdom Crown Collection will respond as soon as possible and aims to provide a substantive response to a complaint within 14 days. 4. If more time is required, the customer will receive an acknowledgment of receipt and an indication of the further handling process within that timeframe.

5. For business customers, the competent court in the Netherlands shall have jurisdiction, to the extent permitted by law, unless agreed otherwise in writing.
